Terms and conditions of sale<\/h1>\n\n\n\n

Introduction and seller details<\/h3>\n\n\n\n

These terms govern purchases of products from Fix&Go Store, referred to as the \u201cWebsite\u201d, from TEK AUTOMOTIVE S.r.l.,<\/strong> referred to as \u201cTEK\u201d or the \u201cSeller\u201d.TEK AUTOMOTIVE S.r.l.Registered office: Passaggio Fratelli Benelli 12, 61121 Pesaro (PU), ItalyVAT and Italian tax number: 02261630418REA registration: PS 166937Customer service: info@fixandgo.com<\/a>Certified email (PEC): tekautomotive@legalmail.it<\/a><\/p>\n\n\n\n

A \u201cConsumer\u201d is an individual purchasing for purposes outside their trade, business, craft or profession. The provisions on consumer withdrawal and the statutory guarantee of conformity apply to purchases made in this capacity. The B2C rates below apply to consumers. Any specific terms for business purchases must be communicated before the order and do not alter consumers\u2019 mandatory rights. <\/p>\n\n\n\n

1. Ordering and formation of the contract<\/h3>\n\n\n\n

1.1. Product pages provide specifications, included items and relevant purchase information. Product listings are invitations to submit an offer to purchase. <\/p>\n\n\n\n

1.2. Customers select products and add them to the cart. Before submitting an order, they can check and correct products, quantities, contact details and the delivery address. Purchases can be made with an account or as a guest, without registration. <\/p>\n\n\n\n

1.3. Before submission, the Customer is shown the order total, shipping costs, payment methods and these terms. By submitting the order through the button indicating an obligation to pay, the Customer makes an offer to purchase and undertakes to pay the stated amount. <\/p>\n\n\n\n

1.4. The contract is formed when the Customer receives TEK\u2019s email confirming acceptance of the order. An email merely acknowledging receipt is not acceptance. The contractual confirmation includes the order summary and applicable terms in a format the Customer can retain. <\/p>\n\n\n\n

1.5. If TEK cannot accept the order, for example because a product is unavailable, it informs the Customer and refunds any amounts received without undue delay. Products are not substituted without the Customer\u2019s consent. <\/p>\n\n\n\n

2. Prices and shipping costs<\/h3>\n\n\n\n

2.1. Prices are in euros and include VAT where applicable. Shipping costs are shown separately before the order is confirmed. <\/p>\n\n\n\n

2.2. TEK may change prices published on the Website. Changes do not apply to orders already submitted. <\/p>\n\n\n\n

2.3. B2C deliveries are available exclusively to the following 27 countries at these rates:<\/p>\n\n\n\n

Rates are in euros and include VAT where applicable. The \u20ac5.99 Italian rate applies to all served postcode ranges. There is no automatic free-shipping threshold. <\/p>\n\n\n\n

2.4. For shipments to T\u00fcrkiye, any customs duties, import taxes and customs clearance charges applicable in the destination country are payable by the Customer and are not included in the shipping rate paid to TEK. Amounts depend on the rules and charges applicable to the import. <\/p>\n\n\n\n

3. Payment and invoicing<\/h3>\n\n\n\n

3.1. Payment is made when the order is submitted. Accepted methods are Visa, Mastercard, American Express, prepaid cards compatible with the supported networks, and PayPal. The available methods are displayed before confirmation. <\/p>\n\n\n\n

3.3. Invoices are not automatically issued for B2C purchases unless required by law. A Customer requiring an invoice must request it within the applicable statutory deadline and provide the necessary details. For instructions, contact info@fixandgo.com before completing the order and payment. Tax obligations applicable to each transaction remain unaffected. <\/p>\n\n\n\n

4. Elaborazione e consegna<\/h3>\n\n\n\n

4.1. Orders are processed Monday to Friday on business days, from 08:30 to 15:00 Italian time. Orders received after 15:00 are processed on the next business day. <\/p>\n\n\n\n

4.2. Courier delivery is expected approximately 60\u201372 hours after payment confirmation. This is an estimate and may be affected by holidays, destination and customs procedures. Different delivery times known at purchase are stated before the order. <\/p>\n\n\n\n

4.3. Once dispatched, the Customer receives an email with a tracking link. For delivery issues, contact info@fixandgo.com and quote the order number. <\/p>\n\n\n\n

4.4. Salvo diverso termine concordato, la consegna al Consumatore avviene senza ritardo ingiustificato e comunque entro 30 giorni dalla conclusione del contratto. In caso di ritardo restano applicabili i rimedi di legge, inclusi la concessione di un termine supplementare quando richiesta e il diritto alla risoluzione e al rimborso nei casi previsti. <\/p>\n\n\n\n

4.5. For consumer purchases, risk of loss or damage passes when the Consumer, or their nominated third party other than the carrier, takes physical possession, except where the Consumer independently appoints a carrier not offered by TEK. Prompt notification and photographs help resolve damage claims; failure to record a reservation with the carrier does not in itself remove consumer rights. <\/p>\n\n\n\n

5. Withdrawal and returns<\/h3>\n\n\n\n

5.1. Consumers have a statutory right to withdraw without giving a reason within 14 calendar days of delivery. Continuing its existing policy, TEK offers a more favourable period of 14 business days, meaning Monday to Friday excluding Italian public holidays, counted from the day after delivery. Any more favourable mandatory time limits remain unaffected. <\/p>\n\n\n\n

5.3. Consumers may notify withdrawal using the \u201cWithdraw from contract\u201d function accessible from the Shipping and returns page, by emailing info@fixandgo.com, or by sending an unequivocal statement to TEK\u2019s registered office. The model form in section 5.9 is optional. No registered-letter confirmation of an email or prior authorisation is required. Notification must be sent within the applicable period. <\/p>\n\n\n\n

5.4. The online function allows the Consumer to identify themselves and the contract, provide an electronic address for the receipt, and confirm their withdrawal statement. TEK sends an acknowledgement on a durable medium without undue delay, including the statement and the date and time of receipt. <\/p>\n\n\n\n

5.5. Goods must be sent back within 14 calendar days of notifying withdrawal. The deadline is met if they are dispatched before it expires. Send returns to:SAVE SRLVia Togliatti 2320066 Melzo (MI), ItalyEnclose a note stating: \u201cRESO per TEK Automotive S.r.l.\u201d <\/p>\n\n\n\n

Please include the order number and purchaser\u2019s name to help identify the return. These details are requested for administrative purposes and are not additional conditions for exercising the right of withdrawal. <\/p>\n\n\n\n

5.6. Le spese dirette di restituzione per ripensamento sono a carico del Consumatore. Il prodotto deve essere imballato in modo adeguato, preferibilmente nella confezione originale, con gli accessori ricevuti. La sola apertura o assenza della confezione originale non comporta automaticamente la perdita del recesso. Il Consumatore risponde soltanto dell\u2019eventuale diminuzione di valore dovuta a manipolazioni eccedenti quelle necessarie per verificare natura, caratteristiche e funzionamento del bene, nei limiti di legge. Ci\u00f2 vale anche per kit e sigillanti: l\u2019erogazione del sigillante pu\u00f2 comportare una diminuzione di valore, ma non introduce un\u2019esclusione generale dei consumabili. <\/p>\n\n\n\n

5.7. TEK refunds amounts due within 14 calendar days of withdrawal notification. Withdrawal from the entire order includes reimbursement of the initial standard delivery charge, but not additional costs of a more expensive delivery option selected by the Customer. TEK may withhold reimbursement until the goods are received or evidence of dispatch is supplied, whichever occurs first, unless TEK has offered to collect the goods. Refunds use the original payment method unless expressly agreed otherwise at no cost to the Consumer. <\/p>\n\n\n\n

5.8. The same procedure applies during TEK\u2019s more favourable commercial withdrawal period. Claims concerning non-conforming goods are governed by section 6 and are not subject to the change-of-mind deadline. <\/p>\n\n\n\n

5.9. Model withdrawal form<\/strong><\/p>\n\n\n\n

6. Statutory guarantee and faulty or incorrect products<\/h3>\n\n\n\n

6.1. Consumer purchases are covered by the statutory guarantee of conformity. For new goods, TEK is responsible for a lack of conformity existing at delivery which becomes apparent within two years, without prejudice to more favourable mandatory protection. <\/p>\n\n\n\n

6.2. Il Consumatore pu\u00f2 ottenere gratuitamente la riparazione o la sostituzione, nei limiti previsti dalla legge; nei casi previsti pu\u00f2 ottenere una riduzione del prezzo o la risoluzione del contratto. 6.3. For faulty, incorrect or damaged goods, email info@fixandgo.com with the order number, product and description of the issue. Photographs, if available, may help assessment. TEK provides instructions for any return or collection. Necessary costs of remedies due under the statutory guarantee are borne by the Seller. <\/p>\n\n\n\n

6.4. La garanzia legale non copre danni causati da uso improprio o inosservanza delle istruzioni quando non dipendano da un difetto di conformit\u00e0. Eventuali garanzie commerciali aggiuntive non sostituiscono n\u00e9 limitano la garanzia legale. Per gli acquisti professionali si applicano le garanzie e le disposizioni di legge pertinenti e gli eventuali accordi specifici. <\/p>\n\n\n\n

7. Uso dei prodotti e responsabilit\u00e0<\/h3>\n\n\n\n

Products must be used in accordance with instructions, warnings, operating limits and applicable expiry dates. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for defective products, or mandatory consumer rights. <\/p>\n\n\n\n

8. Applicable law and disputes<\/h3>\n\n\n\n

The contract is governed by Italian law. Consumers resident in other countries retain any mandatory protection applicable under conflict-of-laws rules. The choice of Italian law does not deprive them of that protection. <\/p>\n\n\n\n

Complaints may be sent to info@fixandgo.com. Consumers retain the right to bring proceedings before the courts competent under applicable law, including the courts of the consumer\u2019s place of residence where provided. Information on alternative dispute resolution bodies is available through the European Consumer Redress<\/a> portal. This reference does not imply TEK\u2019s participation in a particular scheme or restrict access to the courts. <\/p>\n\n\n\n

9. Changes to these terms<\/h3>\n\n\n\n

TEK publishes updated versions on the Website. Orders already submitted remain subject to the version available when they were submitted. Customers can save or print the terms and retain the contractual confirmation received. <\/p>\n\n\n\n

10. Personal data<\/h3>\n\n\n\n

Personal data are processed for the purposes and in the manner described in the Privacy Policy available on the Website. Cookies and similar technologies are described in the Cookie Policy.
